WIOA Unified and Combined State Plans Two-Year Modification Requirements New
The Departments of Education and Labor announce the release of Two-Year Modification Requirements for Workforce Innovation and Opportunity Act (WIOA) Unified and Combined State Plans. The guidance outlines the two-year modification requirements, submission process, and deadline for submitting the modifications for the Unified and Combined State Plans for Program Years 2018 and 2019. States are required to submit their two-year modification to the departments by March 15, 2018.
WIOA State Plan Modification Information Collection New
WIOA requires the Governor of each State to submit a Unified or Combined State Plan to the Secretary of Labor that includes a four-year strategy for the State’s workforce development system, and to submit a modification to that plan after two years. The Required Elements for Submission of the Unified and Combined State Plan and Plan Modifications Under the WIOA provides guidance to States on the preparation and updating of the State Plan (approved by the Office of Management and Budget, OMB Control No. 1205-0522, January 2018). Currently approved State Plans are available on the RSA website.
WIOA Annual Performance Report Submission
OCTAE announces the release of Program Memorandum 17-7: WIOA Annual Performance Report Submission, developed jointly by the Departments of Education and Labor. The program memorandum provides information to States on when the WIOA annual performance report must be submitted in order to be considered timely, as well as information on the sanction provisions for Program Year 2016.
WIOA Performance Accountability Guidance
The Departments of Education and Labor announce the publication of technical revisions to OCTAE Program Memorandum 17-2: Performance Accountability Guidance for Workforce Innovation and Opportunity Act (WIOA) Title I, Title II, Title III and Title IV Core Programs, published on December 19, 2016. The policy guidance provides sub-regulatory guidance on the requirements set forth in WIOA related to the implementation and operation of the performance accountability system under section 116 of WIOA and the implementing joint regulations. The changes to the program memorandum are outlined in Attachment 12 of the guidance.
WIOA Guidance on Supplemental Wage Information for Performance Accountability
OCTAE announces the release of Program Memorandum 17-6: Guidance on the use of Supplemental Wage Information to implement the Performance Accountability Requirements under the Workforce Innovation and Opportunity Act (WIOA). The program memorandum, developed jointly by the U.S. Departments of Education and Labor, provides sub-regulatory guidance on the requirements established by WIOA and its implementing regulations regarding the use of supplemental wage information, when appropriate, to assist in carrying out the performance accountability requirements under section 116 of WIOA.
OCTAE Guidance on Use of Funds for Activities Under Section 243 of AEFLA
OCTAE announces the release of Program Memorandum 17-5: Use of Funds Reserved for Activities under Section 243 of the Adult and Family Literacy Act (AEFLA), Title II of the Workforce Innovation and Opportunity Act (WIOA); The program memorandum provides guidance to States regarding the use of funds reserved for activities under section 243 of AEFLA for FY 2016 and subsequent program years.
Sample Memorandum of Understanding and One-Stop Infrastructure Costs Toolkit
The Workforce Innovation and Opportunity Act (WIOA) established new requirements for the development of MOUs in the one-stop service delivery system. WIOA Guidance on Infrastructure Funding of the One-Stop Delivery System
OCTAE announces the publication of Program Memorandum 17-3: Infrastructure Funding of the One-Stop Delivery System. The program memorandum, developed jointly by the U.S. Departments Labor, Education, and Health and Human Services, provides guidance on the operating costs of the one-stop delivery system, in accordance with the requirements set forth in WIOA and its implementing regulations.
WIOA One-Stop Operations Guidance for the American Job Center Network
OCTAE announces the publication of Program Memorandum 17-4: One-Stop Operations Guidance for the American Job Center Network, jointly developed by the U.S. Departments of Labor, Education, and Health and Human Services. The program memorandum provides general guidance for the implementation of operational requirements under WIOA pertaining to the one-stop delivery system.
Competitive Selection of One-Stop Operators
The U.S. Department of Labor’s Employment and Training Administration announces the release of Training and Employment Guidance Letter (TEGL) 15-6 – Competitive Selection of One-Stop Operators. The TEGL provides information on the requirements to designate or certify one-stop operators through a competitive process, as set forth in section 121(d)(2)(A) of WIOA.
WIOA American Job Centers Common Identifier and Branding
The Department of Labor released frequently asked questions (FAQs) on the branding and common identifier requirements for American Job Centers (AJC). WIOA One-Stop Infrastructure Frequently Asked Questions
The departments of Education and Labor are issuing answers to frequently asked questions (FAQs) related to the one-stop infrastructure cost requirements under WIOA. The departments will release more detailed guidance related to these and other one-stop infrastructure issues in the future.
WIOA Section 188 Nondiscrimination and Equal Opportunity Final Rule
The U.S. Department of Labor’s Civil Rights Center (CRC) announces publication of WIOA Section 188 nondiscrimination and equal opportunity regulations (29 CFR Part 38) in the Federal Register on December 2, 2016. The rule’s updated provisions generally reflect obligations already imposed by changes to other nondiscrimination and equal opportunity laws that expanded, for example, protections against unlawful discrimination on the basis of disability, national origin (including limited English proficiency), and sex. Workforce Innovation and Opportunity Act The Workforce Innovation and Opportunity Act (WIOA) was signed into law (Pub. L. 113-128) by President Obama on July 22, 2014. This Act reauthorizes the Adult Education and Family Literacy Act (AEFLA) with several major revisions.
Workforce Innovation and Opportunity Act Final Rules
The U.S. departments of Labor and Education have collectively issued five rules to implement the Workforce Innovation and Opportunity Act (WIOA) (Pub. L. 113-128).

WIOA 30-Day Notice for the Workforce Innovation and Opportunity Act Common Performance Reporting The U.S. departments of Labor and Education are issuing revisions related to WIOA Common Performance Reporting. The 30-day information collection request appears in the January 9 Federal Register. The comment period closes February 8, 2018.
WIOA Joint and Program-specific Performance Information Collection Requests (ICR) The U.S. departments of Labor and Education collaboratively issued WIOA provisions related to joint performance accountability. The associated documents encompassed in this release include: a Participant Individual Record Layout, reporting calculation specifications, and quarterly and annual report templates. All of these documents have been approved by the Office and Management and Budget (OMB Control No. 1205-0526) for collection through June 30, 2019.
Extension of Existing NRS Information Collection Request (ICR) – Response to Public Comments
In the fall of 2016, OCTAE published a proposed extension of an existing NRS ICR for public review and comment. The ICR included four new tables and one revised table consistent with the WIOA performance accountability requirements for the AEFLA program. In March 2017, OCTAE published responses to the public comments received and the ICR was made available again for public review and comment for 30 days. The comment period closed on April 21, 2017. - Final WIOA Unified and Combined State Plan Requirements Available States must use the information Collection Request (ICR) for the Workforce Innovation and Opportunity Act (WIOA) Unified and Combined State Plans Requirements.
