TO: School District and ESP Superintendents

RE: Application for Waivers and Guidelines

I am sending you the long-awaited application for districts seeking waivers under the Oregon 21st Century Schools and Federal Educational Flexibility Demonstration Programs. This application allows school districts to use a single form for waiver of federal or state requirements. This application is short and I trust you will find it relatively easy to complete.

In the past, districts have sometimes applied for a waiver when none was required. If you have questions about whether or not a waiver is needed in particular situation, please call the Office of Curriculum, Instruction and Field Services before completing the application.

We also though that districts might not be aware that several kinds of waivers are available. The first two waivers require a written request to the State Board of Education, the second two require completion of the attached application.

  1. Waiver of specific standard: Standards for public elementary and secondary school in OAR Division 22.
    OAR 581-22-802 allows school districts to petition for waiver of a specific standard if the waiver request conforms with the intent of the standards.
  2. Waiver or extension of timeline: House Bill 2991 timelines for program implementation waived for one or two years.
    File request with State Board of Education including written plan for full implementation and the method to be used to measure progress toward implementation.
  3. 2001 Waiver: State requirements that limit the ability of schools to implement district or school improvement plans.

  4. Ed Flex Waiver: Federal regulatory requirements under certain federal laws.
